Photo: REUTERS\/Andrew Innerarity.<\/em><\/span><\/p>\n<p style=\"text-align: left;\"><strong>Christiane Amanpour,\u00a0<em>CNN<\/em><\/strong>\u00a0<span style=\"color: #000080;\">chief international anchor,\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.jns.org\/antisemitism\/lucy-dee\/23\/5\/22\/290094\/\" target=\"_blank\" rel=\"noreferrer noopener\">apologized<\/a>\u00a0live on air on May 22 to Rabbi Leo Dee, whose wife, Lucy Dee, and two of his daughters\u2014Maia, 20, and Rina, 15\u2014were shot and killed in early April after terrorists shot at them while driving through the Jordan Valley.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">Last week, Amanpour referred to the incident as a \u201cshootout\u201d rather than a targeted \u201cshooting.\u201d The news anchor said she \u201cmisspoke\u201d and conveyed her apology to Dee.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">Dee has said that he is considering suing\u00a0<em>CNN<\/em>\u00a0for\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.jns.org\/jns\/cnn\/23\/5\/23\/290135\/\" target=\"_blank\" rel=\"noreferrer noopener\">$1.3 billion<\/a>. Alan Dershowitz, attorney and emeritus professor at Harvard Law School, confirmed to JNS that he has been retained to represent Dee on a pro bono basis.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">Dershowitz told JNS that Dee called and asked him to look into a potential lawsuit. \u201cI think what Christiane Amanpour did was beneath contempt. I also don\u2019t think it was a slip or an accident,\u201d Dershowitz said. \u201cI think it\u2019s part of a long pattern of equating terrorists and their victims morally.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The attorney added that he and the rabbi are \u201cexploring various options.\u201d He also answered several questions from JNS.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><em>Responses have been lightly edited for style.<\/em><\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><strong>Q: You\u2019re still considering a lawsuit, even though she\u2019s apologized?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><strong>A:\u00a0<\/strong>Oh, yes. The apology doesn\u2019t negate the lawsuit. The apology was a very grudging apology. Basically, she first tried to apologize privately, but when he wouldn\u2019t accept the apology privately, she was essentially forced to make this grudging apology on the air.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">That may have some impact on damages, but it certainly doesn\u2019t have any legal impact. What she said was defamatory. The rabbi and his family are not public figures. So there\u2019s no malice requirement. The only requirement is that she said something that was false. And it was false. That\u2019s defamation.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">It also caused enormous emotional harm. There are various questions that arise: Where to bring a lawsuit? Who is the plaintiff in the lawsuit? What is the precise nature of the legal claim? Those are all issues that are being explored.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><strong>Q: Do you think there is a good chance of\u00a0<em>CNN<\/em>\u00a0paying for this?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><strong>A:<\/strong>\u00a0I would hope there\u2019s a good chance to hold\u00a0<em>CNN<\/em>\u00a0accountable. The one thing that I would look forward to is an opportunity to cross-examine Christiane Amanpour about her long history of making mistakes only in one direction.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">I\u2019ve issued a challenge to her. I challenge her to point me to one mistake she\u2019s ever made about the Middle East which favors Israel.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">You\u2019d think if there were a bunch of mistakes, one of them would favor Israel. But all of her mistakes, as far as I can tell, all the ones I\u2019ve heard always go the other way.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><strong>Q: Is a lawsuit what it\u2019s going to take to persuade her?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><strong>A:<\/strong>\u00a0I don\u2019t know. Let\u2019s see.\u00a0<em>CNN<\/em>\u00a0has said they\u2019re going to be changing their policies.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">I\u2019m also involved in a\u00a0<a style=\"color: #000080;\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.577926\/gov.uscourts.flsd.577926.290.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>\u00a0with\u00a0<em>CNN<\/em>\u00a0about my speech in the Senate. I know CAMERA has been doing a lot of research on\u00a0<em>CNN<\/em>, and I\u2019ve seen some of it. It\u2019s devastating. It\u2019s so biased, and this was one of the worst. It fits a pattern. It\u2019s not isolated.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><strong>Q: What are some of the other things that\u00a0<em>CNN<\/em>\u00a0has done that fit this pattern?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><strong>A:\u00a0<\/strong>The way they reported on the shooting of that journalist (the late\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.jns.org\/topic\/shireen-abu-akleh\/\" target=\"_blank\" rel=\"noreferrer noopener\">Shireen Abu Akleh<\/a>, of\u00a0<em>Al Jazeera<\/em>). Just generally the way they\u2019ve reported, it\u2019s always an \u201cexchange of fire.\u201d That\u2019s a pattern.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">When rockets are fired from Gaza,\u00a0<em>CNN<\/em>\u00a0portrays it as: \u201cIt\u2019s a back and forth.\u201d Even if the rockets were fired (at Israel) without any provocation from Israel. When we do the research for cross-examination, we\u2019ll come up with every single instance of that kind of reporting. But at the moment, there\u2019s enough for me to say we ought to be looking into this and looking hard.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><strong>Q: Do you think there is a different climate here after the big\u00a0<em>Fox News\u00a0<\/em>settlement?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><strong>A:<\/strong>\u00a0Yes. I think it is changing. I think the Supreme Court is giving a good, hard look at some of its precedents. I think the widespread distrust of the media and the bias of the media has permeated common views of ordinary people.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\">I think it\u2019s a good time. And we\u2019ll have to make the case. There are lots of places where this can be brought. It can be brought in Israel. It can be brought in England. It can be brought in the United States. It can be brought in almost any place.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><em>CNN<\/em>\u00a0is worldwide, and she\u2019s an international correspondent. So what she said was seen all over the world.<\/span><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><strong>Q: What do you think\u00a0<em>CNN\u00a0<\/em>or Amanpour should have done differently following the statement in order to avoid a lawsuit?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" style=\"text-align: left;\"><span style=\"color: #000080;\"><strong>A:<\/strong>\u00a0They should have come out with a profuse apology and talked about how they\u2019re going to look into how this happened.
