Photo: Matt Hrkac\/Wikimedia Commons.<\/em><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Earlier this month, Australia upended nearly a decade of precedent when the government announced that it will start referring to the West Bank, eastern Jerusalem, and Gaza as \u201coccupied Palestinian territories\u201d rather than \u201cdisputed\u201d lands.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The Australian government claims it is \u201cadvancing the cause of peace,\u201d but how this move advances peace is not readily apparent. The change simply accepts the Palestinian framing of a key issue at a time when the Palestinian Authority (PA) can&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.fdd.org\/analysis\/2023\/08\/11\/abbas-sacks-palestinian-governors\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.fdd.org\/analysis\/2023\/08\/11\/abbas-sacks-palestinian-governors\/&amp;source=gmail&amp;ust=1692861349222000&amp;usg=AOvVaw3ZYCJZM0fIHdVD0lnzlE9_\">barely control<\/a>&nbsp;the West Bank, let alone negotiate with Israel.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">In 2014, Australia\u2019s then-Attorney General George Brandis&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.theguardian.com\/world\/2014\/jun\/05\/australia-drops-occupied-israeli-settlements\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.theguardian.com\/world\/2014\/jun\/05\/australia-drops-occupied-israeli-settlements&amp;source=gmail&amp;ust=1692861349222000&amp;usg=AOvVaw20ODkjfyB65JPF2CHbTZwU\">explained<\/a>&nbsp;that the government would stop using the term \u201coccupied\u201d because it is mistaken to \u201cdescribe areas of negotiation in such judgmental language.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">He said that the word is \u201cfreighted with pejorative implications which is neither appropriate nor useful.\u201d Instead, the government opted for the term \u201cdisputed,\u201d which more accurately describes the legal status of the territories.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Since the end of the British Mandate in 1948, no government has exercised undisputed sovereignty over the West Bank, Gaza, or eastern Jerusalem. Jordan conquered the territories during Israel\u2019s war of independence, but few countries recognized Jordan\u2019s claim. When Israel won control of the lands in the Six-Day War, it did not claim sovereignty. The Palestinians now claim the rights to govern these territories, but according to the Oslo Accords that created the PA, negotiations with Israel must first resolve the land\u2019s status.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Australian policy reflected this until August 8, when Canberra flipped the script. Foreign Minister Penny Wong announced the change, and even described the Gaza Strip as occupied, despite the withdrawal of all Israeli forces and residents in 2005.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Wong represents the Australian Labor Party (ALP), which secured a majority in Australia\u2019s May 2022 elections. Her announcement regarding the territories came less than two weeks before the ALP\u2019s national conference, which began in Brisbane on August 17.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The timing is not coincidental.&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.msn.com\/en-ca\/news\/world\/australias-government-has-taken-an-anti-israel-stance-opinion\/ar-AA1fjP04\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.msn.com\/en-ca\/news\/world\/australias-government-has-taken-an-anti-israel-stance-opinion\/ar-AA1fjP04&amp;source=gmail&amp;ust=1692861349222000&amp;usg=AOvVaw07RP0F4qx6Mlnsn_qiKm5m\">Reportedly<\/a>, ALP leaders were at odds with the far left over \u201ctwo foreign policy matters\u201d in the run-up to the conference: the Israeli-Palestinian conflict, and a nuclear-powered submarine deal that the previous government negotiated with the United States and United Kingdom.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The ALP split the difference. The party&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.australianjewishnews.com\/occupied-palestinian-territory\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.australianjewishnews.com\/occupied-palestinian-territory\/&amp;source=gmail&amp;ust=1692861349222000&amp;usg=AOvVaw2be12kKAdc3xLNfji_CoYH\">reportedly<\/a>&nbsp;\u201ctor[e] down one of those foreign policy pillars, which is support for Israel, to preserve the other.\u201d A spokesperson for the opposition&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.smh.com.au\/politics\/federal\/labor-to-harden-position-on-palestine-20230808-p5dutd.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.smh.com.au\/politics\/federal\/labor-to-harden-position-on-palestine-20230808-p5dutd.html&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw2T5osmPp-8xrd3xWJb6O31\">told<\/a>&nbsp;the press that the change in policy has \u201ceverything to do with managing factional differences\u201d and \u201cnothing to do with advancing a lasting two-state outcome.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Australia has been an ally of Israel for decades; the two enjoyed particularly close ties under Australia\u2019s previous government. In February 2022, for example, then Prime Minister Scott Morrison rejected an Amnesty International report that wrongly accused Israel of \u201capartheid.\u201d&nbsp; Wong herself&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/aild.org.au\/statement-by-senator-hon-penny-wong-on-the-amnesty-international-report-labeling-israel-an-apartheid-state-2-february-2022\/#:~:text=%E2%80%9CLabor%20does%20not%20agree%20with%20the%20use%20of,%E2%80%9CAustralia%20must%20stand%20up%20for%20human%20rights%20everywhere.\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/aild.org.au\/statement-by-senator-hon-penny-wong-on-the-amnesty-international-report-labeling-israel-an-apartheid-state-2-february-2022\/%23:~:text%3D%25E2%2580%259CLabor%2520does%2520not%2520agree%2520with%2520the%2520use%2520of,%25E2%2580%259CAustralia%2520must%2520stand%2520up%2520for%2520human%2520rights%2520everywhere.&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw2lm0UAuFUupKdwjqIoIUXS\">said<\/a>&nbsp;the accusation was \u201cnot helpful in progressing the meaningful dialogue and negotiation necessary to achieve a just and enduring peace.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">But under ALP rule, Australia\u2019s Israel policy has started to backslide. In October 2022, the government&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.nytimes.com\/2022\/10\/18\/world\/middleeast\/australia-jerusalem-israel-capital.html#:~:text=JERUSALEM%20%E2%80%94%20Australia%20rescinded%20on%20Tuesday,praise%20from%20the%20Palestinian%20leadership.\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nytimes.com\/2022\/10\/18\/world\/middleeast\/australia-jerusalem-israel-capital.html%23:~:text%3DJERUSALEM%2520%25E2%2580%2594%2520Australia%2520rescinded%2520on%2520Tuesday,praise%2520from%2520the%2520Palestinian%2520leadership.&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw1PDlBZVxbOT83qpcR74Ja3\">reversed<\/a>&nbsp;Morrison\u2019s decision to recognize western Jerusalem as the capital of Israel. And this year, Australia signed two&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.abc.net.au\/news\/2023-02-16\/australia-condemns-israel-over-occupied-west-bank-settlements\/101986598\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.abc.net.au\/news\/2023-02-16\/australia-condemns-israel-over-occupied-west-bank-settlements\/101986598&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw1jC2rKMxzFZSus2dG1pIT4\">joint<\/a>&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.foreignminister.gov.au\/minister\/penny-wong\/media-release\/joint-statement-australia-canada-and-united-kingdom-following-recent-events-israel-and-west-bank\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.foreignminister.gov.au\/minister\/penny-wong\/media-release\/joint-statement-australia-canada-and-united-kingdom-following-recent-events-israel-and-west-bank&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw3dt5JfolVLuKjQ4HQhVRdw\">statements<\/a>&nbsp;with other Western governments condemning Israeli settlement construction in the West Bank.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Wong&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.timesofisrael.com\/australia-pledges-to-reinstate-use-of-term-occupied-palestinian-territories\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.timesofisrael.com\/australia-pledges-to-reinstate-use-of-term-occupied-palestinian-territories\/&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw0QqqwIyETa-6u8pnwOIidw\">insisted<\/a>&nbsp;last week that the government in Canberra remains a \u201ccommitted friend of Israel.\u201d She defended the decision to adopt the term \u201cOccupied Palestinian Territories\u201d as a move consistent with United Nations and European Union practice.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Thankfully, ALP has yet to lead Canberra completely off the deep end. Last October, a United Nations Commission of Inquiry (COI) investigating the Israeli-Palestinian conflict \u201cset forth grounds to&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2022\/10\/commission-inquiry-finds-israeli-occupation-unlawful-under-international-law\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.ohchr.org\/en\/press-releases\/2022\/10\/commission-inquiry-finds-israeli-occupation-unlawful-under-international-law&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw2C7Xugdjr1xztBSHrfohCO\">conclude\u201d<\/a>&nbsp;that Israel\u2019s presence in the West Bank is \u201cnow unlawful under international law.\u201d Two months later, the United Nations General Assembly passed a&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.un.org\/unispal\/document\/res-77-247\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.un.org\/unispal\/document\/res-77-247\/&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw0dUbF-H-s-dJvz9y-X-8dE\">resolution<\/a>&nbsp;requesting that the ICJ issue an advisory opinion echoing the COI\u2019s finding. Australia&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/digitallibrary.un.org\/record\/3999158?ln=en\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/digitallibrary.un.org\/record\/3999158?ln%3Den&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw1IJDxpE-SqzRVgjG8Q8EXY\">voted against<\/a>&nbsp;the resolution \u2014 justifiably.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Israel\u2019s West Bank presence is the result of a defensive war it won in 1967. Having tried and failed multiple times to negotiate a \u201cland for peace\u201d agreement, the Palestinian leadership has consistently rebuffed Israel\u2019s terms.&nbsp; The Israelis have thus sustained their presence in these disputed territories.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Facts notwithstanding, the ICJ appears poised to rule against Israel and advise that international law requires Israel\u2019s swift and unilateral withdrawal from the West Bank. A bipartisan group of American lawmakers&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/jewishinsider.com\/2023\/06\/international-court-of-justice-israel-u-s-state-department\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/jewishinsider.com\/2023\/06\/international-court-of-justice-israel-u-s-state-department\/&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw3H24opHmb1w32ZINMPuZ_C\">warned<\/a>&nbsp;that such an outcome \u201cwould almost certainly be used to further the propaganda assault and the Boycott, Divestment, and Sanctions (BDS) movement against Israel while simultaneously undermining the credibility and effectiveness of UN human rights bodies.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Fifteen judges sit on the ICJ, including one from Australia. And while ICJ judges are independent, their decisions&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.fdd.org\/analysis\/2023\/07\/21\/pending-icj-case-threatens-to-demand-unconditional-israeli-withdrawal-from-west-bank\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.fdd.org\/analysis\/2023\/07\/21\/pending-icj-case-threatens-to-demand-unconditional-israeli-withdrawal-from-west-bank\/&amp;source=gmail&amp;ust=1692861349223000&amp;usg=AOvVaw1XFEW0FlHyovTLZTXNdm7I\">often reflect<\/a>&nbsp;the priorities of their home countries. The first round of submissions in the ICJ proceedings were due on July 25. Australia did not file, and is thus precluded from direct intervention in the proceedings. But in the wake of its misguided shift in language, the ALP government can still redeem itself. It should make clear that Australia stands by Israel amidst an ongoing delegitimization campaign.
