Photo: Image Press Agency via Reuters Connect<\/em><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The Walt Disney Company filed&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/deadline.com\/wp-content\/uploads\/2024\/04\/carano-disney-dismissal-filing.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">a motion<\/a>&nbsp;on Tuesday night to dismiss a wrongful discharge and sex discrimination lawsuit filed by actress Gina Carano, who was fired from the Disney+ series&nbsp;<em>The Mandalorian&nbsp;<\/em>for comparing the political divides in America to Nazi Germany.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Disney wants Carano\u2019s lawsuit dismissed \u201con the grounds that Disney has a constitutional right not to associate its artistic expression with Carano\u2019s speech, such that the First Amendment provides a complete defense to Carano\u2019s claims.\u201d The Bob Iger-led company said the actress and former mixed martial arts fighter was fired from the&nbsp;<em>Star<\/em>&nbsp;<em>Wars<\/em>-based series in 2021 because she chose \u201cto publicly trivialize the Holocaust by comparing criticism of political conservatives to the annihilation of millions of Jewish people \u2014 notably, not \u2018thousands\u2019 \u2014 [which] was the final straw for Disney.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">\u201cThe First Amendment protects Disney\u2019s right to protect its own speech from association with Carano\u2019s high-profile, controversial speech,\u201d added the company in its motion this week. \u201cBecause the state cannot impose liability on Disney for making that decision, Carano\u2019s claims should be dismissed.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Disney is asking for a hearing on June 12 in federal court in downtown Los Angeles before Judge Sherilyn Peace Garnett. Disney is a defendant in the case alongside Lucasfilms and Huckleberry Industries. The entertainment giant purchased<em>&nbsp;Star Wars&nbsp;<\/em>creator George Lucas\u2019 Lucasfilm in 2012 for just over $4 billion.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Carano starred as bounty hunter Cara Dune in the first two seasons of&nbsp;<em>The Mandalorian.&nbsp;<\/em>In February 2021, not long after the second season of&nbsp;<em>The Mandalorian&nbsp;<\/em>finished airing on Disney+, Carano shared on social media a TikTok post that<a style=\"color: #000080;\" href=\"https:\/\/twitter.com\/JonathanKentJ\/status\/1566269504425889792\/photo\/1\" target=\"_blank\" rel=\"noopener noreferrer\">&nbsp;said<\/a>: \u201cJews were beaten in the streets, not by Nazi soldiers but by their neighbors \u2026 even by children. Because history is edited, most people today don\u2019t realize that to get to the point where Nazi soldiers could easily round up thousands of Jews, the government first made their own neighbors hate them simply for being Jews. How is that any different from hating someone for their political views?\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Shortly afterward, Lucasfilm, which co-produces&nbsp;<em>The Mandalorian<\/em>, announced Carano\u2019s firing from the show. It said her social media posts \u201cdenigrating people based on their cultural and religious identities are abhorrent and unacceptable.\u201d A month later, Disney\u2019s CEO at the time, Bob Chapel, explained that Carano\u2019s views \u201cdidn\u2019t align with company values,\u201d including its \u201cvalues of respect, values of decency, values of integrity, and values of inclusion.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Carano filed a lawsuit in Feb. 2024, claiming she was wrongfully fired and that her \u201cwords were consistently twisted to demonize &amp; dehumanize me as an alt right wing extremist.\u201d Her lawsuit is receiving financial support from X\/Twitter and Tesla owner Musk, who offered to pay legal fees for anyone who faces alleged discrimination because of their social media activity on his social media platform.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Disney said in its motion on Tuesday that it \u201chad enough\u201d after seeing Carano\u2019s social media post about Nazi Germany. The company said the actress \u201cgrotesquely trivialized the Holocaust as comparable to sharp political disagreements.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Carano responded to Disney\u2019s motion on Thursday.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">\u201cDisney has confirmed what has been known all along, they will fire you if you say anything they disagree with, even if they have to MISREPRESENT, MALIGN, and MISCHARACTERIZE you to do it,\u201d she wrote in a&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/twitter.com\/ginacarano\/status\/1778487464572899657\" target=\"_blank\" rel=\"noopener noreferrer\">post<\/a>&nbsp;on X. \u201cThey are now on record letting everyone who works for them know that Disney will take any chance they get to control what you say, what you think or they will attempt to destroy your career.
