The International Court of Justice, the principal judicial arm of the United Nations located in The Hague, issued a non-binding, 83-page\u00a0opinion<\/a>\u00a0on Friday declaring Israeli \u201coccupation\u201d of Judea and Samaria to be \u201cunlawful.\u201d<\/span><\/p>\n

\u201cThe court reaffirms that the Israeli settlements in the West Bank and East Jerusalem, and the r\u00e9gime associated with them, have been established and are being maintained in violation of international law,\u201d the U.N. high court stated.<\/span><\/p>\n

Israel is \u201cobliged to bring an end to its presence in the Occupied Palestinian Territory as rapidly as possible,\u201d the court added. Julia Sebutinde, of Uganda, the court\u2019s vice-president, was the only one to dissent on all of the counts, which passed either 14-1, 14-3, 12-3 or 11-4.<\/span><\/p>\n

Israeli Prime Minister Benjamin Netanyahu denounced the ruling on Friday.\uf8e7<\/span><\/p>\n

\u201cThe Jewish people are not occupiers in their own land, including in our eternal capital Jerusalem nor in Judea and Samaria, our historical homeland,\u201d he said. \u201cNo absurd opinion in The Hague can deny this historical truth or the legal right of Israelis to live in their own communities in our ancestral home.\u201d<\/span><\/p>\n

The Israeli Ministry of Foreign Affairs\u00a0wrote<\/a>\u00a0that the \u201cfundamentally wrong\u201d opinion \u201cmixes politics and law\u201d and \u201cis completely detached from the reality of the Middle East.\u201d<\/span><\/p>\n

\u201cIt injects the politics of the corridors of the U.N. in New York into the courtrooms of the ICJ in The Hague,\u201d the ministry said.<\/span><\/p>\n

Israel Gantz, head of the Binyamin Regional Council and chairman of the Yesha Council, stated that the court\u2019s opinion \u201cdeserves condemnation and denunciation from all countries around the world.\u201d He also called on Netanyahu to \u201cimmediately begin applying sovereignty to Judea and Samaria.\u201d<\/span><\/p>\n

\u201cThis is a decision contrary to justice, contrary to the Bible, morality and international law,\u201d he said. \u201cThis decision is intended to bring Hamas terrorists closer to the beds of our children and women in the center of the country and to eliminate the State of Israel.\u201d<\/span><\/p>\n

\u201cThe Western Wall, the Cave of the Patriarchs, Jerusalem and all of Judea, Samaria, Binyamin and the Jordan Valley are the land of our ancestors,\u201d Gantz added. \u201cNo opinion will erase the historical truth or undermine the deep connection between the people of Israel and its country.\u201d<\/span><\/p>\n

Palestinian leader Mahmoud Abbas \u201cwarmly\u00a0welcomed<\/a>\u201d the court\u2019s opinion, which he called a \u201ctriumph for justice,\u201d and \u201curged the international community to compel Israel, the occupying power, to fully and immediately end its occupation and colonial project without conditions or exceptions.\u201d<\/span><\/p>\n

\u2018Politically motivated\u2019<\/strong><\/h4>\n

Harriet Schleifer and William Daroff, chair and CEO respectively of the Conference of Presidents of Major American Jewish Organizations, condemned the court\u2019s ruling \u201cin the strongest terms.\u201d<\/span><\/p>\n

\u201cThe ICJ, like the entire United Nations\u2019 system, is rife with antisemitism and anti-Israel bias\u2014this verdict has given us simply more proof of what was already evident,\u201d the two leaders stated. \u201cThe accusations in the ruling amount to a modern-day blood libel.\u201d<\/span><\/p>\n

Arsen Ostrovsky, CEO of the International Legal Forum, told JNS that the \u201cobscene\u201d decision will fuel antisemitism and reward Hamas for its Oct. 7 terror attack. The opinion \u201cis yet another utterly baseless and politically motivated decision of the court, masquerading as a legal opinion, that will only further erode the ICJ\u2019s credibility and place it squarely as a tool of Palestinian lawfare,\u201d he said.<\/span><\/p>\n

\u201cAlbeit non-binding, this opinion, delivered by the Hezbollah-controlled Lebanese presiding judge, with a pre-existing deep-seated history of anti-Israel bias, is rooted in historical revision and denial of the Jewish people their inalienable connection to their holy sites, including Jerusalem,\u201d the international human rights lawyer added.<\/span><\/p>\n

Anne Herzberg, legal adviser at NGO Monitor, told JNS that the court\u2019s decision \u201cmust be seen within the context of the ongoing war to eliminate Israel as the nation-state of the Jewish people.\u201d<\/span><\/p>\n

\u201cIn addition to military action in every conflict, there is also a political warfare component, and this opinion is a clear part of this campaign,\u201d Herzberg said. \u201cWhile less than half of U.N. member states sought this opinion, the Lebanese-led court has issued a wide-ranging, ahistorical opinion that completely erases the security reality, attacks Jewish self-determination rights and cultural heritage and eviscerates Oslo and the Middle East Peace Process.\u201d<\/span><\/p>\n

The opinion \u201cwill likely lead to further antisemitic violence which is surging globally,\u201d she added. \u201cFor all of these reasons, countries of conscience should forcefully reject it.\u201d<\/span><\/p>\n

\u201cNeither the U.N. nor the ICJ has the authority to make pronouncements about Judea and Samaria,\u201d stated the leadership of Christians United for Israel, which referred to the \u201cgross overreach and willful blindness to indisputable facts of anti-Israel activist judges.\u201d<\/span><\/p>\n

\u201cIn a world comfortable with Jew-hatred, the concept of alternative facts and a court led by an anti-Israel judge, we do not expect the international community will see the light of truth anytime soon,\u201d it added.<\/span><\/p>\n
