Photo: REUTERS\/Kacper Pempel<\/em><\/span><\/p>\n<div id=\"post_content\">\n<p><span style=\"color: #000080;\">Canada has\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.baytoday.ca\/city-police-beat\/north-bay-man-sentenced-to-jail-for-holocaust-denial-and-antisemitic-hate-speech-11288875\" target=\"_blank\" rel=\"noopener\">handed down<\/a>\u00a0its first-ever jail sentence for Holocaust denial.<\/span><\/p>\n<p><span style=\"color: #000080;\">A court in North Bay, Ontario, sentenced Kenneth Paulin, 51, to nine months behind bars and two years of probation after finding him guilty of willfully promoting hatred against Jews and \u201ccondoning, denying, or downplaying the Holocaust.\u201d Crown prosecutors confirmed that the ruling on Sept. 18 marked the first time in Canadian history that someone has received imprisonment specifically for denying the historical reality of the Nazi genocide against the Jewish people.<\/span><\/p>\n<p><span style=\"color: #000080;\">The conviction followed a seven-month investigation by the North Bay Police Service\u2019s Criminal Investigation Section. Police said they launched the probe in November 2024 after receiving complaints about Paulin\u2019s online posting. Following multiple warrants and a request to Ontario\u2019s Attorney General for formal approval, law enforcement arrested and charged Paulin in June.<\/span><\/p>\n<p><span style=\"color: #000080;\">Authorities said his assortment of social media posts and videos targeted Jews with slurs, conspiracy theories, and calls to violence. He called Jews \u201cdemons\u201d and said they are \u201cto blame for every American who falls.\u201d He condemned Jews as responsible for \u201calmost 100 percent\u201d of the world\u2019s problems. He even called for a \u201cWorldwide Jew Hunt\u201d and said that \u201cantisemitism is the only thing that can save the world.\u201d In one video he titled \u201cTheir victim card gets permanently denied as the hollow-cost-Hoax is exposed\u201d he mocked the Holocaust as a \u201choax,\u201d while another post read, \u201cSix million didn\u2019t happen, but it should\u2019ve.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">In a community impact submission to the court, Jaime Kirzner-Roberts, senior director of policy and advocacy at the Friends of Simon Wiesenthal Center for Holocaust Studies (FSWC),\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.fswc.ca\/news\/court-issues-first-ever-jail-sentence-in-canada-for-holocaust-denial\" target=\"_blank\" rel=\"noopener\">described<\/a>\u00a0the content as \u201can orchestrated effort to spread hatred, to normalize antisemitism, and to encourage others to view Jews as enemies to be mocked, hunted, and destroyed.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">Kirzner-Roberts said that \u201cthe vile antisemitism we are confronting today has inflicted deep and lasting harm on Jewish Canadians, the minority group most frequently targeted by hate crimes in this country. But it\u2019s important to note that such hatred does not end with Jews \u2013 it corrodes our democracy, emboldens extremists, and threatens the values that hold Canada together.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">The statement praised those who had investigated, charged, and prosecuted Paulin.<\/span><\/p>\n<p><span style=\"color: #000080;\">\u201cWe are grateful to police, the Attorney General, and Crown prosecutors for ensuring this precedent-setting case was pursued with the seriousness it deserves. We are also pleased that a jail sentence has been handed down, not only for the incitement of hatred against Jews, but also for the denial and glorification of the Holocaust,\u201d Kirzner-Roberts stated. \u201cBy standing firmly against such hateful rhetoric, this ruling affirms that every Canadian deserves to live with dignity, safety and freedom, free from intimidation, dehumanization, and fear.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">The North Bay Police Service stressed that the case was a reflection of the impact that hate crimes can have on a community. Acting Deputy Chief Jeff Warner said the investigation demonstrated \u201cthe great work being done by the officers in our Criminal Investigation Section\u201d and emphasized a commitment to \u201csending the message that hate has no place in today\u2019s society.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">Canada\u2019s Criminal Code has long criminalized the \u201cwillful promotion of hatred\u201d under\u00a0<a style=\"color: #000080;\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/section-319.html\" target=\"_blank\" rel=\"noopener\">Section 319<\/a>, but until recently it did not explicitly single out Holocaust denial. That changed in 2022, when the Canadian Parliament adopted\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.justice.gc.ca\/eng\/trans\/bm-mb\/other-autre\/c19\/remarks-remarques.html\" target=\"_blank\" rel=\"noopener\">Bill C-19<\/a>, a budget law that added a new subsection, 319(2.1), making it a crime to \u201cwillfully promote antisemitism by condoning, denying, or downplaying the Holocaust.\u201d The amendment carries a maximum of two years\u2019 imprisonment.<\/span><\/p>\n<p><span style=\"color: #000080;\">The statute defines the Holocaust as \u201cthe planned and deliberate state-sponsored persecution and annihilation of European Jewry by the Nazis and their collaborators,\u201d and applies to public communications outside private conversation.<\/span><\/p>\n<p><span style=\"color: #000080;\">With the new subsection, Canada joins a group of countries that explicitly outlaw Holocaust denial. In\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/article\/germanys-laws-antisemitic-hate-speech-nazi-propaganda-holocaust-denial\/\" target=\"_blank\" rel=\"noopener\">Germany<\/a>, Section 130 of the criminal code (<i>Volksverhetzung<\/i>) makes denial, trivialization, or glorification of the Nazi genocide punishable by up to five years in prison. In France, the 1990 Gayssot Act criminalizes questioning crimes against humanity, including the Holocaust. Austria, Belgium, Hungary, Poland, and Romania are among the other countries with similar laws. A<a style=\"color: #000080;\" href=\"https:\/\/www.europarl.europa.eu\/RegData\/etudes\/BRIE\/2021\/698043\/EPRS_BRI%282021%29698043_EN.pdf\" target=\"_blank\" rel=\"noopener\">\u00a02021 study by the European Parliament<\/a>\u00a0noted wide variation in enforcement but confirmed that the principle is well-established in Europe that Holocaust denial is not protected speech but a form of incitement.<\/span><\/p>\n<p><span style=\"color: #000080;\">Paulin\u2019s conviction reflects the continued proliferation of Holocaust denial propaganda, which can often reflect the paradoxical sentiment of rejecting the historicity of the Nazis\u2019 crimes against humanity, while simultaneously wishing they had occurred, as the convict revealed in his posting \u201cSix million didn\u2019t happen, but it should\u2019ve.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">A\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.unesco.org\/en\/articles\/unesco-social-media-study-exposes-virulent-holocaust-denial-and-distortion\" target=\"_blank\" rel=\"noopener\">UNESCO report<\/a>\u00a0in 2022 found that 16.2 percent of Holocaust-related content on major social media platforms involved denial or distortion. On fringe platforms, the proportion rose to 49 percent. The\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.un.org\/en\/outreach-programme-holocaust\/social-media-feeds-holocaust-denial-and-distortion-finds-un-report\" target=\"_blank\" rel=\"noopener\">United Nations<\/a>\u00a0has warned that social media continues to amplify denial narratives, feeding extremist propaganda and violent ideologies.<\/span><\/p>\n<p><span style=\"color: #000080;\">In Canada, antisemitic hate crimes have spiked to new highs. According to an annual audit by B\u2019nai Brith Canada, there\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.cbc.ca\/news\/politics\/bnai-brith-antisemitic-report-record-high-1.7195197\" target=\"_blank\" rel=\"noopener\">were<\/a> 5,791 incidents reported in 2023, with nearly half occurring online.
