Photo: ZUMA Press Wire via Reuters Connect<\/em><\/span><\/p>\n<div id=\"post_content\">\n<p><span style=\"color: #000080;\">Hamas\u2019 October 7 massacre, and the subsequent war against Israel, motivated sympathizers of the terrorist group to persecute Jews worldwide, even though the practice of blaming Jews for the actions of Israel is a globally recognized form of\u00a0<a style=\"color: #000080;\" href=\"https:\/\/holocaustremembrance.com\/resources\/working-definition-antisemitism\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/holocaustremembrance.com\/resources\/working-definition-antisemitism&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw0CQm1RP7u3uuTxfok-weET\">antisemitism<\/a>.<\/span><\/p>\n<p><span style=\"color: #000080;\">In the US,\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.adl.org\/resources\/article\/pro-hamas-chant-queens-synagogue-protest-signals-further-normalization-terror\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.adl.org\/resources\/article\/pro-hamas-chant-queens-synagogue-protest-signals-further-normalization-terror&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw0TAvGgAKJGec9NzMCdJB2_\">dozens<\/a>\u00a0of these antisemitic campaigns targeted synagogues.<\/span><\/p>\n<p><span style=\"color: #000080;\">In recent months, the bigoted rallies grew especially menacing at two New York synagogues that hosted events for a non-profit corporation called Nefesh B\u2019Nefesh (NBN). NBN conducts information fairs that promote \u201caliyah\u201d (immigration) to Israel, and it guides interested parties through the naturalization process.<\/span><\/p>\n<p><span style=\"color: #000080;\">During the NBN gatherings, congregants could not enter or exit the synagogues without encountering harassment and intimidation by hundreds of angry demonstrators.<\/span><\/p>\n<p><span style=\"color: #000080;\">The haters obstructed the entrances while\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.jpost.com\/diaspora\/antisemitism\/article-874577\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.jpost.com\/diaspora\/antisemitism\/article-874577&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw35bkowCYg61S-z-tzzwhgc\">screaming<\/a>\u00a0antisemitic obscenities and incitements such as \u201cIntifada revolution\u201d and \u201cResistance you make us proud; take another settler out.\u201d At one of the synagogues, the protestors endorsed antisemitic terrorism by\u00a0<a style=\"color: #000080;\" href=\"https:\/\/qns.com\/2026\/01\/mamdani-anti-zionist-protest-hamas\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/qns.com\/2026\/01\/mamdani-anti-zionist-protest-hamas\/&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw03LGzBK4XU_R41uqpF5o6V\">chanting,<\/a>\u00a0\u201cSay it loud, say it clear, we support Hamas here.\u201d Meanwhile, a member of the crowd repeatedly\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.jta.org\/2025\/11\/20\/politics\/after-protest-outside-ues-synagogue-mamdani-says-israel-immigration-event-misused-sacred-space\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.jta.org\/2025\/11\/20\/politics\/after-protest-outside-ues-synagogue-mamdani-says-israel-immigration-event-misused-sacred-space&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw1jHo4MxV2NZe6rfbRqDBqx\">shouted,<\/a>\u00a0\u201cWe need to make them scared.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">On January 13, 2026, New York Governor Kathy Hochul (D) pledged to curb such synagogue-focused hostility by legislating protest-free buffer zones for all houses of worship. Each buffer zone would form a 25-foot perimeter around the property of the religious institution. Outside the boundary, demonstrators could freely exercise their First Amendment right to scream and shout. Inside the line, worshipers could safely enter and exit the facility, engage in their freedoms of speech and religion, and enjoy their right of privacy to avoid the rowdy mob.<\/span><\/p>\n<p><span style=\"color: #000080;\">Pro-Palestinian organizations oppose the New York buffer zone proposal. The advocates\u00a0<a style=\"color: #000080;\" href=\"https:\/\/ccrjustice.org\/home\/press-center\/press-releases\/civil-rights-groups-warn-against-ny-gov-hochuls-anti-palestinian#:~:text=Civil%20Rights%20Groups%20Warn%20Against,Protests%20%7C%20Center%20for%20Constitutional%20Rights\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/ccrjustice.org\/home\/press-center\/press-releases\/civil-rights-groups-warn-against-ny-gov-hochuls-anti-palestinian%23:~:text%3DCivil%2520Rights%2520Groups%2520Warn%2520Against,Protests%2520%257C%2520Center%2520for%2520Constitutional%2520Rights&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw14Is7RHy5BZ6AFGwyJyFFn\">claim<\/a>\u00a0that NBN illegally sells \u201cstolen\u201d Palestinian land. In their view, the slated law would not only \u201ccensor\u201d their free speech right to denounce the alleged NBN crimes, but make New York State \u201ccomplicit\u201d in the supposed wrongdoing. They\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.thejewishnews.com\/jewish-telegraphic-agency\/new-york-s-governor-is-introducing-a-bill-to-curb-synagogue-protests-now-comes-the\/article_9678f922-a787-48a4-ba95-ae4d090bf523.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.thejewishnews.com\/jewish-telegraphic-agency\/new-york-s-governor-is-introducing-a-bill-to-curb-synagogue-protests-now-comes-the\/article_9678f922-a787-48a4-ba95-ae4d090bf523.html&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw2Hpw9sy2v_AmQcP47YUvmD\">call<\/a>\u00a0the information fairs \u201cnon-religious political events.\u201d<\/span><\/p>\n<p><span style=\"color: #000080;\">New York City Mayor Zohran Mamdani (D), who is openly pro-Palestinian, remains noncommittal on the buffer zone scheme. But he opposes NBN,\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.jta.org\/2025\/11\/20\/politics\/after-protest-outside-ues-synagogue-mamdani-says-israel-immigration-event-misused-sacred-space\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.jta.org\/2025\/11\/20\/politics\/after-protest-outside-ues-synagogue-mamdani-says-israel-immigration-event-misused-sacred-space&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw1jHo4MxV2NZe6rfbRqDBqx\">arguing<\/a>\u00a0that \u201csacred spaces\u201d should not be used to breach international law.<\/span><\/p>\n<p><span style=\"color: #000080;\">The mayor and buffer zone opponents misconstrue the applicable law. The\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/248\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.law.cornell.edu\/uscode\/text\/18\/248&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw3SfBxuXWlAg64pVUVxWEHV\">1994 Freedom of Access to Clinic Entrances (FACE) Act<\/a>\u00a0prohibits close-range harassment, intimidation, and physical interference at houses of worship, as well as reproductive health clinics.<\/span><\/p>\n<p><span style=\"color: #000080;\">Within this Federal framework, states and municipalities have enacted buffer zones to separate potentially dangerous protestors from those who frequent the protected sites. The Supreme Court has\u00a0<a style=\"color: #000080;\" href=\"https:\/\/firstamendment.mtsu.edu\/article\/hill-v-colorado\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/firstamendment.mtsu.edu\/article\/hill-v-colorado\/&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw3jG6-U11wLzTHI-UTGYMq9\">upheld<\/a>\u00a0the use of buffer zones to balance the adversarial rights involved. Based on subsequent case law, a thin, 25-foot buffer zone, such as the one designed for New York, is valid because it is \u201cnarrowly tailored\u201d to meet its Constitutional goals.<\/span><\/p>\n<p><span style=\"color: #000080;\">Demonstration organizers cannot credibly portray NBN presentations as non-religious political events. In Judaism, \u201cmaking aliyah\u201d means \u201cgoing up\u201d to settle in the Biblical Promised Land. The\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.chabad.org\/library\/article_cdo\/aid\/1584066\/jewish\/What-Is-Aliyah.htm\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.chabad.org\/library\/article_cdo\/aid\/1584066\/jewish\/What-Is-Aliyah.htm&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw2dAPPxQlEODxYPMd3dEgz9\">ascent<\/a>\u00a0is a religious rite that Jews have performed for millennia. That is why NBN extends its outreach to synagogues. Even if NBN\u2019s operations were purely political, they would deserve just as much First Amendment protection as any religious affair.<\/span><\/p>\n<p><span style=\"color: #000080;\">Another misconception is that NBN sells land. In reality, the outfit merely provides guidance on how to find housing.<\/span><\/p>\n<p><span style=\"color: #000080;\">The broader accusation that Israel illegally builds settlements on occupied Palestinian land is also untrue. The territories claimed by Palestinians have already been lawfully allocated to the state that became Israel, pursuant to the\u00a0<a style=\"color: #000080;\" href=\"https:\/\/ecf.org.il\/media_items\/299\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/ecf.org.il\/media_items\/299&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw2zdFVuwxWd13oTJKCR3gFW\">1920 San Remo Treaty<\/a>\u00a0and\u00a0<a style=\"color: #000080;\" href=\"https:\/\/avalon.law.yale.edu\/20th_century\/palmanda.asp\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/avalon.law.yale.edu\/20th_century\/palmanda.asp&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw2HR9dAGLUDnrAmo_CJAqri\">1922 British Mandate for Palestine<\/a>. Occupation law applies when a state captures foreign land, but not when it settles its own land. A temporary exception to Israel\u2019s sovereign reach was established when Israel and the Palestinians negotiated interim spheres of territorial control \u2014 called \u201cAreas A, B and C\u201d \u2014 in the\u00a0<a style=\"color: #000080;\" href=\"https:\/\/avalon.law.yale.edu\/21st_century\/isrplo.asp\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/avalon.law.yale.edu\/21st_century\/isrplo.asp&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw2fca78JLd7LKRwJg1_HxZK\">Oslo Accords of the 1990s<\/a>. Those limits are strictly observed by Israelis.<\/span><\/p>\n<p><span style=\"color: #000080;\">The International Court of Justice\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.icj-cij.org\/node\/204176\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.icj-cij.org\/node\/204176&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw27V9NCfvQEm0k7U234MaNf\">ruling<\/a>\u00a0referenced by the protest partisans to claim NBN is selling or promoting settlement on stolen land was an \u201cadvisory opinion,\u201d which means it had no legally binding effect. It\u2019s just as well. A dissenting judge on the court rightly rebuked the decision for failing to recognize Israel\u2019s territorial rights. The US government recognizes Israel\u2019s territorial rights. Any buffer zone objectors who dispute that US position should lobby the Trump administration, not Governor Hochul, because the Constitution\u00a0<a style=\"color: #000080;\" href=\"https:\/\/www.justia.com\/international-law\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.justia.com\/international-law\/&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw3eWonbCUM7epxJRg3AeAC_\">reserves<\/a>\u00a0matters of international relations exclusively for the Federal government.<\/span><\/p>\n<p><span style=\"color: #000080;\">Regardless of whether Israeli settlements comply with international law, nothing in that legal realm can supersede the Constitutional safeguards planned for New York\u2019s synagogues. The US government is legally barred from accepting any international obligation\u00a0<a style=\"color: #000080;\" href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artII-S2-C2-1-9\/ALDE_00012960\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/constitution.congress.gov\/browse\/essay\/artII-S2-C2-1-9\/ALDE_00012960\/&amp;source=gmail&amp;ust=1769663404347000&amp;usg=AOvVaw0OmUu2vG10w-uuRyB-aKYn\">inconsistent<\/a>\u00a0with the Constitution.<\/span><\/p>\n<p><span style=\"color: #000080;\">The current trend of unbridled antisemitism has trampled on Jewish civil rights. Some of the worst offenders are those who harass Jews at the entrances to their synagogues. A buffer zone is the bare minimum needed to keep that threat at bay.<\/span><\/p>\n<hr \/>\n<p><span style=\"color: #808080;\"><em><strong>Joel M.
