Photo: Gage Skidmore via Wikimedia Commons.<\/em><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Arizona legislators are trying to amend their existing state hate crime law to track crimes \u201cthat manifest evidence of prejudice based on antisemitism.\u201d A version of the<a style=\"color: #000080;\" href=\"https:\/\/www.azleg.gov\/legtext\/54leg\/2R\/bills\/HB2683H.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.azleg.gov\/legtext\/54leg\/2R\/bills\/HB2683H.pdf&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNFaxlzMW44S_8_AmCvWuiCkSfmUgg\">&nbsp;<span style=\"text-decoration: underline;\"><strong>bill<\/strong><\/span><\/a>&nbsp;passed the House 52-8 in late February with overwhelming bipartisan support. It was expected that the Senate would also pass their version of this&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.azleg.gov\/legtext\/54leg\/2r\/bills\/sb1143s.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.azleg.gov\/legtext\/54leg\/2r\/bills\/sb1143s.pdf&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNGIJx_TU8Cx7wVPVTBC-JJFHivaoA\">legislation<\/a>. That is, until some Democrats did an<span style=\"text-decoration: underline;\"><strong>&nbsp;<a style=\"color: #000080; text-decoration: underline;\" href=\"https:\/\/jewishinsider.com\/2020\/03\/arizona-democratic-lawmaker-disappointed-in-party-leaderships-opposition-to-antisemitism-bill\/\" target=\"_blank\" rel=\"noopener noreferrer\">about-face due to pressure from the ACLU and others<\/a>.<\/strong><\/span><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">Current Arizona law gives the judiciary the option to enhance sentencing in crimes motivated by malice due to a victim\u2019s actual or perceived race, religion, color, disability, national origin, gender or sexual orientation. The proposed amendment, carefully designed to cover only criminal acts, adds the category of \u201cantisemitism\u201d when state officials investigate and track crime with potential discriminatory motivation. Additionally, under the bill, officials are required to use the International Holocaust Remembrance Alliance (IHRA)&nbsp;<span style=\"text-decoration: underline;\"><strong><a style=\"color: #000080; text-decoration: underline;\" href=\"https:\/\/www.holocaustremembrance.com\/working-definition-antisemitism\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.holocaustremembrance.com\/working-definition-antisemitism&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNHbATmnEsef6IpzuDUqtBLlTkyoMg\">working definition of antisemitism<\/a><\/strong><\/span>&nbsp;as an evaluative tool to decide when criminal conduct is motivated by antisemitism.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The sponsors of this legislation believe that the addition of the category \u201cantisemitism\u201d to existing law will result in better tracking of bias crimes, and provide more accurate data to help policy decision-making. Arizona is not alone in its efforts to use the IHRA antisemitism definition as an evaluative tool. Legislators in Iowa are&nbsp;<span style=\"text-decoration: underline;\"><strong><a style=\"color: #000080; text-decoration: underline;\" href=\"https:\/\/www.legis.iowa.gov\/docs\/publications\/LGI\/88\/HF2303.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.legis.iowa.gov\/docs\/publications\/LGI\/88\/HF2303.pdf&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNHQeyY5twICNic3LC4NIqAu7CGb0A\">arguing for<\/a><\/strong><\/span>&nbsp;the inclusion of this definition in their discrimination law as well.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The internationally-accepted IHRA working definition of antisemitism, also adopted by the US Departments of State and Justice, encompasses the age-old hatred targeting Jews, as well as modern antisemitism aimed at Israel as a proxy for Jews. It clearly distinguishes between legitimate criticisms of Israel that are protected as free speech, and expressions that cross the line into unprotected antisemitic hate speech. Among the many examples of contemporary Jew-hatred are \u201cdenying the Jewish people their right to self-determination,\u201d claiming that the existence of Israel is a \u201cracist endeavor,\u201d and \u201cdrawing comparisons of contemporary Israeli policy to that of the Nazis.\u201d<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">With legislators eager to address growing antisemitism in Arizona, the effort had large-scale support \u2014 that is, until the ACLU and the anti-Israel organizations&nbsp;<span style=\"text-decoration: underline;\"><strong><a style=\"color: #000080; text-decoration: underline;\" href=\"https:\/\/www.adl.org\/resources\/backgrounders\/students-for-justice-in-palestine-sjp\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.adl.org\/resources\/backgrounders\/students-for-justice-in-palestine-sjp&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNHYQI6kwLnR4tZVvNnKj9qAd9UEOA\">Students for Justice in Palestine<\/a><\/strong><\/span>,&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.adl.org\/resources\/profiles\/american-muslims-for-palestine\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.adl.org\/resources\/profiles\/american-muslims-for-palestine&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNEcRBk7JASTOLoyYRNatauS2EbPLw\"><span style=\"text-decoration: underline;\"><strong>American Muslims for<\/strong><\/span> <span style=\"text-decoration: underline;\"><strong>Palestine<\/strong><\/span><\/a>&nbsp;and the&nbsp;<span style=\"text-decoration: underline;\"><strong><a style=\"color: #000080; text-decoration: underline;\" href=\"https:\/\/www.adl.org\/sites\/default\/files\/documents\/assets\/pdf\/israel-international\/israel--middle-east\/Profile-The-Council-on-American-Islamic-Relations.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.adl.org\/sites\/default\/files\/documents\/assets\/pdf\/israel-international\/israel--middle-east\/Profile-The-Council-on-American-Islamic-Relations.pdf&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNER7AGaaubBf3-zApcPDz-oU37OQQ\">Council on American-Islamic Relations (CAIR)<\/a><\/strong><\/span>&nbsp;and others launched a well-orchestrated and effective campaign of \u201cintimidation by misinformation\u201d in the Senate. They&nbsp;<span style=\"text-decoration: underline;\"><strong><a style=\"color: #000080; text-decoration: underline;\" href=\"https:\/\/www.acluaz.org\/sites\/default\/files\/coalition_letter_in_opposition_to_sb1143_-_march_4_2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.acluaz.org\/sites\/default\/files\/coalition_letter_in_opposition_to_sb1143_-_march_4_2020.pdf&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNGLdBb77GOToE-5gZMOjmbUlnZw1w\">charged<\/a><\/strong><\/span>&nbsp;that the bill uses the IHRA definition as a weapon to stifle free speech. Even though the bill clearly&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/www.azleg.gov\/legtext\/54leg\/2r\/bills\/sb1143s.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.azleg.gov\/legtext\/54leg\/2r\/bills\/sb1143s.pdf&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNGIJx_TU8Cx7wVPVTBC-JJFHivaoA\"><span style=\"text-decoration: underline;\"><strong>states<\/strong><\/span><\/a>&nbsp;that \u201cantisemitism does not include criticism of Israel similar to that leveled against any other country,\u201d opponents nevertheless claimed that the bill criminalizes criticism of Israel.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">According to one of the bill\u2019s Democratic sponsors, support among Democratic<a style=\"color: #000080;\" href=\"https:\/\/jewishinsider.com\/2020\/03\/arizona-democratic-lawmaker-disappointed-in-party-leaderships-opposition-to-antisemitism-bill\/\" target=\"_blank\" rel=\"noopener noreferrer\">&nbsp;<span style=\"text-decoration: underline;\"><strong>leaders<\/strong><\/span><\/a>&nbsp;quickly evaporated<\/span>.<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">The vote in the Senate was postponed, and the legislature recessed due to the coronavirus outbreak. Jake Bennett, Director of State Legislative Affairs for the Israeli-American Coalition for Action, is working to promote the legislation. Interviewed by the Haym Salomon Center, Bennett expressed the opinion that the bill will pass even without full or broad Democratic support. However, he hopes that some Democrats will vote \u201cyes\u201d to maintain the bipartisan nature of this effort and send a united message that antisemitism has no place in Arizona.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000080;\">In the age of coronavirus, when conspiracy theories on both left and right&nbsp;<a style=\"color: #000080;\" href=\"https:\/\/besacenter.org\/perspectives-papers\/coronavirus-conspiracy-theories-jews\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/besacenter.org\/perspectives-papers\/coronavirus-conspiracy-theories-jews\/&amp;source=gmail&amp;ust=1589879061666000&amp;usg=AFQjCNG-DJ8q_Z0koRl_R7Q4I-n5JoGzZw\"><span style=\"text-decoration: underline;\"><strong>blame<\/strong><\/span><\/a>&nbsp;Jews and Israel for the worldwide pandemic, effective hate crime laws are all the more imperative.
