So, after a fashion, is Germany.<\/strong><\/h5>\n<p style=\"text-align: center;\"><img decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/static01.nyt.com\/images\/2021\/07\/15\/world\/15eu-poland-01\/merlin_175365258_fc7cfa88-1bf3-42ad-b5f7-e1774f10dbb8-superJumbo.jpg?quality=90&amp;auto=webp\" width=\"100%\"><span style=\"color: #808080;\"><em>Flags for Poland and the European Union on display before a ceremony last summer in Warsaw.Credit&#8230;Slawomir Kaminski\/Agencja Gazeta, via Reuters<\/em><\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">BRUSSELS \u2014 Poland has escalated&nbsp;<a class=\"css-1g7m0tk\" style=\"color: #000080;\" title=\"\" href=\"https:\/\/www.nytimes.com\/2017\/12\/20\/world\/europe\/eu-poland-law.html\">a six-year struggle with the European Union over the rule of law<\/a>&nbsp;after the country\u2019s constitutional court ruled it did not have to comply with an order from the bloc\u2019s supreme court over its oversight of judges.<\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">The decision by the Polish court on Wednesday followed an order by the top E.U. court, the European Court of Justice, to suspend a disciplinary \u201cchamber\u201d that critics say has been used by the ruling Law and Justice party&nbsp;<a class=\"css-1g7m0tk\" style=\"color: #000080;\" title=\"\" href=\"https:\/\/www.nytimes.com\/2020\/01\/10\/world\/europe\/poland-judges-tuleya.html\">to intimidate judges not to its liking<\/a>. Poland\u2019s top court said&nbsp;<a class=\"css-1g7m0tk\" style=\"color: #000080;\" title=\"\" href=\"https:\/\/trybunal.gov.pl\/postepowanie-i-orzeczenia\/wokanda\/art\/11566-obowiazek-panstwa-czlonkowskiego-ue-polegajacy-na-wykonywaniu-srodkow-tymczasowych-odnoszacych-sie-do-ksztaltu-ustroju-i-funkcjonowania-konstytucyjnych-organow-wladzy-sadowniczej-tego-panstwa?tx_ttnews%5Bday%5D=14&amp;tx_ttnews%5Bmonth%5D=07&amp;tx_ttnews%5Byear%5D=2021&amp;cHash=12662429357d4bf5415b7aa201ec33bb\" target=\"_blank\" rel=\"noopener noreferrer\">that the European court, which is based in Luxembourg, did not have the power to impose such orders under Poland\u2019s Constitution.<\/a><\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">On Thursday, the&nbsp;<a class=\"css-1g7m0tk\" style=\"color: #000080;\" title=\"\" href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2021-07\/cp210130en.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">European Court of Justice said<\/a>&nbsp;that the system of overseeing and disciplining judges in Poland, set up by the ruling party, was not compatible with E.U. law and that its impartiality and independence from political interference cannot be guaranteed.<\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">If Poland does not comply with the E.U. ruling, the European Commission, the bloc\u2019s executive, can ask the court to impose daily fines. The Commission considers Poland\u2019s actions to be a violation of the treaties that bind the bloc together and that guarantee an independent judiciary.<\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">Poland\u2019s government has argued that the disciplinary chamber, which was set up in 2018, was necessary to purge a corrupt system that includes Communist-era holdovers. <\/span><\/p>\n<p style=\"text-align: center;\"><img decoding=\"async\" width=\"100%\" class=\"aligncenter\" src=\"https:\/\/static01.nyt.com\/images\/2021\/07\/15\/world\/15eu-poland-02\/merlin_190874736_b05fcad2-5e2b-4715-bb39-42e023867bdd-superJumbo.jpg?quality=90&amp;auto=webp\"><span style=\"color: #808080;\"><em>The Supreme Court in Warsaw.Credit&#8230;Kacper Pempel\/Reuters<\/em><\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">The head of Poland\u2019s parliamentary commission for justice, Marek Ast, criticized the European court\u2019s ruling, saying that the organization of justice systems should be the responsibility of E.U. member states. \u201cThe standards that E.C.J. is drawing from the E.U. treaties are not in line with Poland\u2019s Constitution,\u201d he said, referring to the court.<\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">Zbigniew Ziobro, Poland\u2019s justice minister, told reporters that the court\u2019s decision was a political one that segregated states \u201cinto better and worse ones.\u201d<\/span><\/p>\n<p class=\"css-axufdj evys1bk0\" style=\"text-align: left;\"><span style=\"color: #000080;\">In another battle over the rule of law, the Commission said on Thursday that it was starting separate legal proceedings against Poland and Hungary over alleged violations of the rights of L.G.B.T.Q. people.
