Israeli High Court Freezes Controversial Settlement Outpost Law

(JNS.org) The Israeli High Court has issued a temporary freeze on the controversial settlement law that allowed for certain Jewish outposts built on Palestinian-owned land to be retroactively legalized.

Known as the Regulation Law, the legislation allows for the Israeli government to expropriate private Palestinian-owned land where previously illegal settlement outposts have been built in good faith or with government support. The law was initiated in response to the controversy surrounding the dismantling of the Amona outpost earlier this year. The constitutionality of the law was quickly challenged by left-wing NGOs.

The High Court’s order freezes any attempts to retroactively legalize settlement outposts for a two-month period, during which time the government has a chance to challenge the decision.

Israeli lawmakers behind the Regulation Law called the High Court’s decision another example of the court overstepping its authority.

“Once again, we see how the High Court of Justice tramples on the separation of powers,” Member of Knesset Shuli Mualem-Refaeli (Jewish Home) said in a statement, adding, “The fight against Jewish settlement in Judea and Samaria, and against Israel’s existence, is being fought through terror and incitement, but through the abuse of Israel’s justice system as well.”

Do dziś zdarza się, że kiedy rozmawiam z Amerykaninem, a podchodzi drugi Amerykanin, to od tej chwili nie reagują na to, co mówię, nie słyszą mnie. Z Henrykiem Grynbergiem rozmawia Donata Subbotko [CYKL “UCHODŹCA”]

Dlaczego pan stąd wyjechał?
– Nie wyjechałem. Uciekłem.

Przed czym?
– Przed antysemityzmem i antysemitami. Tak jak – nie porównując się – Tuwim, Słonimski i Wittlin, którzy wbrew pozorom nie byli uchodźcami wojennymi, bo uciekli, gdy jeszcze nie było pewne, że dojdzie do wojny, i gdy powszechnie wierzono, że jeśli tak, to Niemcy zaraz przegrają. Uciekli od antyżydowskiej propagandy, pogróżek przeciw nim osobiście.

A pan?
– Uciekłem, gdy w Polsce zaczęła się propaganda antyżydowska, która naruszała moją godność ocalałego z Zagłady.

Henryk Grynberg: Żyję dla przeszłości

Pamięta pan moment decyzji?
– Zobaczyłem w „Twórczości” moje opowiadanie tak ocenzurowane, że wiedziałem, że nie będę mógł więcej pisać na mój najważniejszy, żydowski temat. Na jesieni 1967 wyjeżdżałem jako aktor z teatrem Idy Kamińskiej na występy do Nowego Jorku. Postanowiłem, że nie wrócę.

Uchodźca kim jest?
– Zbiegiem szukającym bezpieczeństwa. W moim przypadku kimś, kto nie chciał żyć bez godności.

Co pan zabrał z Polski?
– Dwie walizy z książkami, przeważnie współczesnych pisarzy polskich, z ich dedykacjami. Rozstałem się z nimi dopiero kilka lat temu, oddając je wraz z innymi osobistymi zabytkami do archiwum pisarzy słowiańskich na nowojorskim Uniwersytecie Columbia. Wziąłem również rozmaite słowniki, bałem się rozstania z polskimi słowami.

Z jaką nadzieją pan jechał?
– Znałem Amerykę z dwóch poprzednich pobytów. Moja matka tam mieszkała od 1960 roku. Poczułem się u niej jak w domu. Zamierzałem wystąpić o azyl, ale przekonano mnie, że praktyczniej będzie, jeśli matka zwróci się o przyjęcie mnie jako imigranta w ramach łączenia rodzin.

Miałem tam przyjaciół, którzy zawsze się dziwili, że wracam do Polski, a teraz mi gratulowali, że nareszcie „zmądrzałem”. Nie rozumiałem tylko, co mieli na myśli tacy, co mówili, że podziwiają moją odwagę. Odpowiadałem, że więcej odwagi bym potrzebował, żeby pozostać w Polsce. Później zrozumiałem. Pół roku po mojej ucieczce.

Coś konkretnego się wtedy wydarzyło?
– Zastrzelono mojego ojczyma w jego sklepie w biednej dzielnicy Los Angeles. Niby napad rabunkowy, ale nietypowy, bo z samego rana, gdy prawie nic nie było w kasie. I czy trzeba było aż siedmiu kul? Po latach, czytając w IPN szczegóły dochodzenia, jakie prowadzono w związku z moją ucieczką, doszedłem do wniosku, że to mogła być kara. Z ostrzeżeniem. Pewno dlatego podziwiano moją odwagę.

Kara?
– Większość dokumentów w mojej IPN-owskiej teczce dotyczy dochodzenia, które prowadzono zaraz po mojej ucieczce. Jest tam wzmianka o proteście polskiej ambasady w Departamencie Stanu z powodu moich publicznych wystąpień, zwłaszcza w mediach. Okazało się, że były dokuczliwsze, niż przypuszczałem. O przyczynach swojej ucieczki mówiłem najpierw w wywiadach dla „New York Timesa” i „Los Angeles Timesa” oraz przed kamerami, m.in. stacji CBS. Potem wypowiadałem się dla wielu amerykańskich rozgłośni radiowych, dla gazet żydowskich. Oczywiście dla Wolnej Europy. Obszerniejsze wypowiedzi opublikowałem w londyńskich „Wiadomościach” i paryskiej „Kulturze”. Występowałem też na paru kampusach Uniwersytetu Kalifornijskiego: UCLA i Berkeley, w tym ostatnim razem z Miłoszem.

Raz podczas mojego występu w San Francisco przysiadło się do mnie dwóch nieznajomych, ścisnęli mnie z obu stron tak, że nie mogłem się ruszyć, i indagowali mnie. Cztery miesiące później zastrzelono mojego ojczyma.

A pan czego bał się najbardziej?
– Że przestanę być pisarzem, i o mało tak się nie stało. Gdy zastrzelono ojczyma, nie miałem materialnego oparcia i musiałem pójść do pracy fizycznej. Trafiłem nawet do tej samej hurtowni blach, gdzie przede mną pracował Marek Hłasko, jak to opisałem w książce „Uchodźcy”.

Co pan tam robił?
– Ciąłem i układałem ostre arkusze blachy do wysyłki. Gołymi rękami, w rękawicach nie dałoby się rozdzielić ciężkich, gładkich arkuszy, które do siebie przylegały. Pracowałem tam całe lato 1969 roku. Legalnie, bo miałem już zieloną kartę. Przedtem byłem jakiś czas kierowcą małej ciężarówki w hurtowni kosmetyków, które sam ładowałem, rozwoziłem do sklepów i wyładowywałem. Odszedłem stamtąd, bo magazynier na mnie warczał. Żyd i firma była żydowska, pewno komuch, bo takim w Ameryce nigdy się nie podobałem. Parę miesięcy byłem też sprzedawcą w czymś, co miało być księgarnią, ale sprzedawano tam wyłącznie książki pornograficzne, lubieżnie ilustrowane czasopisma i propagandowy miesięcznik „Soviet Union”.

W hurtowni blach nieźle płacono. Zaoszczędziłem trochę i wstąpiłem na Uniwersytet Kalifornijski, gdzie w ciągu dwóch lat zrobiłem magisterium z rusycystyki. Jesienią 1971 przyjąłem posadę rządową w Waszyngtonie.

Jako przybysz z Polski wstydził się pan czegoś?
– Tego, że podczas poprzednich pobytów w Ameryce przekonywałem ludzi, że w Polsce Ludowej antysemityzm jest pod kontrolą i że przynajmniej pod tym względem jest lepiej, niż było przed wojną. Tego, co się działo w Polsce marcowej i pomarcowej, wstydziła się zresztą większość polskiej emigracji politycznej, bo prześladowania rasowe przeszły najgorsze oczekiwania. Wyraził to Kazimierz Wierzyński w wierszu „Czarny polonez” z puentą: „Polak, który się wstydzi”. Swoją drogą, nie rozumiem, dlaczego w praworządnej Polsce do dziś nie ukarano nikogo za tamto bezprawie.

W Stanach był pan dyskryminowany?
– Pracując w polskiej sekcji radia Głos Ameryki, zauważyłem, że my, pracownicy sekcji językowych – czyli emigranci i uchodźcy – jesteśmy w siatce płac o co najmniej jedną kategorię niżej od naszych amerykańskich kolegów piszących i nadających po angielsku, pomimo że nasza praca była trudniejsza. Łatwiej redagować materiał w tym samym języku, niż tłumaczyć frazeologię, terminologię oraz teksty i podteksty polityczne i dyplomatyczne. Interweniowałem przez związek zawodowy, bezskutecznie. Argumentowano, że anglojęzycznych fachowców trzeba przyciągać wyższymi stawkami, bo pójdą gdzie indziej.

Ale na co dzień dawano panu odczuć, że jest pan „gorszy”?
– Do dziś zdarza się, że kiedy rozmawiam z Amerykaninem, a podchodzi drugi Amerykanin, to od tej chwili nie reagują na to, co mówię, nie słyszą mnie.

Co w kondycji uchodźcy jest najtrudniejsze?
– Alienacja.

Nam bardzo długo nie wierzono. Dopatrywano się u nas „niecnych” tendencji politycznych, uważano za reakcjonistów i szkodników. Psuliśmy „postępowcom” dobre samopoczucie, utrudnialiśmy im ciepłe stosuneczki z instytucjami komunistycznych reżimów. Tak było nie tylko na uniwersytecie, lecz nawet w rządowym Głosie Ameryki. Dopiero masowy ruch „Solidarności” skłonił ich do zmiany orientacji.

A pana doświadczenie uchodźstwa zmieniło?
– Jeden świat mi się zawalił, ale drugi otworzył. W tym drugim jest mi lepiej. Życie w Stanach poszerzyło mi horyzonty. Oduczyło nawyków i odruchów przywiezionych z chamskiego systemu. Zmieniłem się na lepsze. Ceną za to było rozstanie z bliskimi mi ludźmi, z naturalnym środowiskiem. Na zawsze. Nie można po latach wrócić do tego samego kraju, tak jak nie można powtórnie wejść do przysłowiowej tej samej rzeki.

Podobno to do pana odnosi się początek piosenki „W żółtych płomieniach liści” Agnieszki Osieckiej: „Wśród ptaków wielkie poruszenie, / ci odlatują, ci zostają”?
– Agnieszka zatrzymała się u mnie i mojej ówczesnej żony zimą 1968 roku. Wiersz ten z dedykacją dla mnie przysłała mi w liście, który napisała zaraz po wyjeździe, w drodze z Los Angeles do Santa Fé.

Właściwie nigdy nie rozmawialiśmy o mojej sytuacji, ale dwa pierwsze wersy wyraźnie do niej nawiązują i pewno stąd dedykacja. Dalsze wersy: „I ja żegnałam nieraz kogo / I powracałam już nie taka / Choć na mej ręce lśniła srogo / Obrączka srebrna jak u ptaka”, poruszają kwestię wierności małżeńskiej i są aluzją do jej przewlekłego romansu z Hłaską, z którym spotkała się ponownie właśnie u mnie.

Gdyby mógł pan cofnąć czas, podjąłby pan decyzję o ucieczce?
– Tak, to była konieczność. Mądrość żydowska uczy, że jeśli nie można studiować Tory w domu, trzeba opuścić dom. Tora jest tu symbolem wierności sobie i tego, co w życiu najważniejsze.

Rasmea Odeh, a 69-year-old convicted Palestinian terrorist, had her U.S. citizenship revoked by a federal court Thursday.

She will be deported from the U.S. to her native country of Jordan.

Earlier this year, Odeh pleaded guilty to lying to immigration authorities about her criminal record when she applied for American citizenship in 2004.

Specifically, Odeh failed to disclose her conviction and imprisonment in Israel for her role in a 1969 Jerusalem bombing that killed two Hebrew University students. Odeh has previously confessed to planting the bomb in that Jerusalem terror attack, but later claimed her confession was made under duress. In 1970, she was sentenced to life in prison by an Israeli court, and served 10 years of her sentence before being released early in a prisoner exchange deal in 1980.

“Hopefully, this will be the final chapter in the tragic story of this still-dangerous and unrepentant PFLP terrorist who tried to fraud the U.S. immigration services,” said Nitsana Darshan-Leitner, director of the Shurat HaDin – Israel Law Center, which has supported victims of Odeh’s terrorism in the legal proceedings against her. “We applaud the work of the American Department of Justice and in particular Assistant U.S. Attorney Jonathan Tukel, who really pursued Odeh with vigilance, exposed her lies and assured that her Jewish victims received a measure of justice and closure,” Darshan-Leitner said.

JNS.org – The National Library of Israel (NLI) has launched a massive online database of centuries-old Jewish manuscripts from across the world.

The archive — known as Ktiv, Hebrew for “written word”– contains nearly 4.5 million images from 45,000 manuscripts, including prayer books, biblical texts, commentary, philosophy, literature and scientific writings in various Jewish-related languages such as Hebrew, Yiddish, Ladino and Judeo-Arabic.

“To the best of my knowledge, this is unprecedented, not only for Jewish studies and Judaica,” NLI Director Aviad Stollman said, The Associated Press reported. “There is no project with this scope that aggregated so many manuscripts from so many places in the world.”

The database is a collaboration between NLI, the Friedberg Jewish Manuscript Society, the British Library, the Vatican Library and the Italy-based Palatina Library, in an effort to bring almost half of the world’s known volumes of Jewish manuscripts together in one location.

Security Council report says IS adapting to military pressure in Iraq, Syria by delegating responsibility to local commanders

UNITED NATIONS (AP) — The Islamic State extremist group is still capable of sending funds to supporters and motivating attacks in Europe and elsewhere despite military pressure and falling revenue — and al-Qaeda remains resilient especially in West Africa, East Africa and the Arabian Peninsula, UN experts said in a report circulated Thursday.

The experts monitoring sanctions against the extremist groups said competition between the Islamic State and al-Qaeda continues, but “shifting alliances” among fighters “and cooperation on the tactical level in several regions also allow them to move between various groups.”

The report said the extremist threat continues to rise in Southeast Asia, where IS wants to establish a foothold. It said recent events in the southern Philippines, where the city of Marawi has been under siege by IS-linked fighters for more than two months, is evidence of this.

The experts said in the report to the UN Security Council that “the core” of the Islamic State extremist group is adapting to military pressure in Iraq and Syria by delegating decision-making responsibility to local commanders and switching to encrypted communications

Several member states highlighted “the increasingly creative use of drones” by IS, primarily in Iraq and Syria. They said the group is developing the capability to design and construct larger drones which will increasingly enable it “to weaponize the drones, thereby increasing its ability to strike at a distance,” according to the report.

It said IS “continues to send funds to its affiliates worldwide” and is likely to do so as long as the group has the means. IS leaders have also sent money to places where the group doesn’t have affiliates in an attempt to prepare for its eventual defeat in Iraq and Syria, according to an unidentified UN member state quoted in the report.

The experts quote several member states as saying IS fighters returning home generally fall into three categories: Those disenchanted with the extremist group “and terrorism as an ideology” who can potentially be deradicalized and reintegrated into society; a much smaller group of high-risk individuals who return with the aim of conducting “terror attacks”; and individuals who have cut ties with IS but “remain radicalized and are ready to join another terrorist group should the opportunity arise.”

The report assessed extremist trends by region:

— Attacks in Europe in the first half of 2017 demonstrate that “Europe remained a priority region” for IS attacks, it said. However, thus far in 2017 the group hasn’t conducted an attack in which the IS “core” is involved in detailed planning and decision-making, sending fighters and providing financial resources, the report said. It quoted some member states reporting “an increase in radicalization and violent extremism” linked to IS networks in Europe.

— In Iraq, the report quoted several member states saying key IS leaders left Mosul prior to the attack by Iraqi forces supported by the US-led coalition. But it said IS resistance in Mosul “indicates that its command and control structure has not broken down completely and that the group remains a significant military threat.” In Syria, the report said key IS members also left their stronghold of Raqqa ahead of an expected attack and air strikes.

— The Arabian Peninsula faces “a significant threat” from al-Qaeda and IS in Yemen, the report said. It said a member state reported that over 30 IS-related “terrorist plots” have been disrupted in the region, including one in June targeting the Grand Mosque in Mecca, and Jeddah in Saudi Arabia. It said the importance of Al-Qaeda in the Arabian Peninsula for the terrorist group is demonstrated by a statement from Osama bin Laden’s son, Hamza bin Laden, encouraging sympathizers to join al-Qaeda training camps in Yemen.

— In North Africa, the report said IS cells claimed several attacks in Libya in the first half of 2017 following the extremist group’s ouster from Sirte. It quoted a member state estimating the number of IS fighters in Libya at between 400 and 700. In Tunisia, it said the threat from IS and al-Qaeda remains “a source of concern.”

— In West Africa, the report said “al-Qaeda affiliates remain resilient and present a significant threat to Mali and, to a lesser extent, the Sahel region.” According to member states, al-Qaeda affiliated groups continue to attack military forces and have intelligence capabilities to monitor movements of security and military patrols “and conduct complex attacks,” it said.

— East Africa faces “terrorist threats” from both al-Qaeda affiliate al-Shabab, which has approximately 6,000 to 9,000 members, and IS affiliates operating in parts of southern Somalia and its semi-autonomous state of Puntland.

— In Afghanistan, the report said IS has intensified its competition with the Taliban “and aims to expand.” But it said despite recruitment efforts in the last three years, “the group has not yet established a viable fighting force there.” It said the Taliban “continues to wield substantial influence over regional al-Qaeda affiliates.” It quoted one member state saying currently more than 7,000 foreigners are fighting in Afghanistan for the Taliban and al-Qaeda affiliates.

— In Southeast Asia, the report said the situation “remains precarious.” It said that while “terrorist groups” are believed to be ideologically divided over IS, the group’s propaganda on its so-called “caliphate” has resonated with extremists in the region. The report said at least seven attacks in 2016 targeting Malaysia, Indonesia and the Philippines can be attributed to pro-IS fighters.
